Company Rights and Design Usage

1. Ownership of Custom Designs

Customer Submissions: When you submit a design request, photos, or other materials for customization, you retain ownership of the intellectual property rights to those materials, provided that you have the legal right to use them. By submitting these materials, you grant Thread Lab a limited, non-exclusive license to use the submitted materials solely for the purpose of creating and fulfilling your custom order.

Final Custom Designs: Upon completion of your custom order, the final design created by Thread Lab becomes the property of the customer. However, Thread Lab retains the right to use, modify, and display the design for promotional, marketing, and advertising purposes, unless otherwise agreed in writing.

2. License to Use Customer-Provided Designs

Usage Rights: By submitting custom design requests (including, but not limited to, logos, images, text, or other artwork), you grant Thread Lab a non-exclusive, royalty-free license to use the design materials provided solely for the purpose of creating your custom product. This license allows us to make, reproduce, and distribute the design solely to fulfill your order. You are solely responsible for ensuring that you have the right to use and share any content provided for your custom product.

Prohibited Content: You agree not to submit any designs or content that infringe upon the intellectual property rights of others, including copyrighted images, trademarks, or any other content you do not have the right to use. You will indemnify Thread Lab against any claims or disputes resulting from the infringement of third-party rights.

3. Company’s Intellectual Property

Ownership of Designs and Materials: All designs, artwork, logos, and other creative materials produced by Thread Lab, including templates, design concepts, and unapproved or discarded designs, remain the intellectual property of Thread Lab. These designs are protected under copyright law and may not be used, reproduced, or distributed without explicit permission from Thread Lab.

Right to Modify and Use: Thread Lab retains the right to modify, adapt, or use any custom design for marketing or promotional purposes, including on our website, social media accounts, and in advertising materials, unless specifically prohibited by a signed agreement between us and the customer. We may also use such designs in portfolios or as part of our work samples, with or without attribution, unless otherwise agreed.

4. Design Exclusivity

Non-Exclusive Nature of Custom Designs: Unless explicitly stated in writing, custom designs produced by Thread Lab are non-exclusive. This means that Thread Lab retains the right to create similar or identical designs for other customers or use the design for other purposes. However, we will not use the exact design submitted or created for you in another custom product unless agreed upon.

Exclusivity Agreements: If you wish to secure exclusive rights to a particular design, this must be negotiated and documented in a separate agreement. Additional fees or conditions may apply to such arrangements.

5. Design Reproduction and Use

Reproduction: You are granted permission to reproduce your custom design only for personal use, and not for commercial or resale purposes unless specified in an agreement. Commercial use or reproduction of the custom design without our written consent is prohibited.

Attribution: You may not claim the custom design as your own work in any promotional materials, unless you have an agreement that grants you the right to do so.Thread Lab retains the right to credit the company for its role in creating the design, unless otherwise specified in the contract.
